HEALTH & FITNESS LIABILITY WAIVER

AND ASSUMPTION OF RISK AGREEMENT

Effective Date: March 2026

This Health & Fitness Liability Waiver and Assumption of Risk Agreement (“Agreement”) is entered into between you (“Participant”) and Dr Fitness International LLC (“Company”).

This Agreement applies to all programs, services, memberships, coaching, online content, live sessions, workshops, in-person sessions, digital materials, and related activities provided by the Company, including but not limited to:

Body Design Formula™

New Earth Codex™

Dr Fitness International™

Customized programs

Online courses

In-person sessions

Private coaching

By participating in any service, you acknowledge and agree to the following:

1. Voluntary Participation

I understand that my participation in fitness training, movement practices, postural correction, strength training, breathwork, embodied practices, coaching sessions, and related activities is voluntary.

I understand that I may stop participation at any time.

2. Acknowledgment of Physical Risks

I understand that participation in exercise and movement programs involves inherent risks, including but not limited to:

Muscle strains and sprains

Joint injuries

Ligament or tendon injuries

Back or neck injury

Cardiovascular stress

Dizziness or fainting

Abnormal blood pressure responses

Heart attack or stroke (rare but possible)

Aggravation of pre-existing conditions

I understand that not all risks can be predicted.

I knowingly and voluntarily assume full responsibility for all risks associated with participation.

3. Breathwork and Emotional Release

I understand that breathwork, embodiment practices, and coaching conversations may produce emotional responses or psychological reactions.

I acknowledge that I am responsible for monitoring my own mental and emotional state during participation.

The Company does not provide mental health therapy or psychological treatment.

4. No Medical Advice

I understand that Dr Fitness International LLC and its instructors are not licensed medical doctors, healthcare providers, or therapists.

The information provided is not medical advice and is not intended to diagnose, treat, cure, or prevent any medical condition.

I agree to consult with my physician prior to beginning any program, especially if I have:

Heart conditions

High blood pressure

Musculoskeletal injuries

Neurological conditions

Respiratory conditions

Pregnancy

Any other medical concerns

If I choose not to consult a physician, I accept full responsibility for that decision.

5. Representation of Health Condition

I represent that:

I am physically and mentally capable of participating in these activities; OR

I have obtained medical clearance to participate; OR

I knowingly assume all risks despite any medical condition.

I agree to immediately stop any activity that causes pain, dizziness, discomfort, or concern.

6. In-Person Session Risks

For any in-person session or event, I understand there are additional environmental risks, including but not limited to:

Equipment malfunction

Slips or falls

Facility conditions

Interaction with other participants

I assume full responsibility for my conduct and safety during in-person participation.

7. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Dr Fitness International LLC, its owners, officers, instructors, agents, contractors, and affiliates from any and all claims, demands, damages, causes of action, or liability arising from:

Personal injury

Illness

Emotional distress

Property damage

Death

Any loss sustained during participation

This release applies whether caused by negligence or otherwise, except in cases of gross negligence or intentional misconduct.

8. Indemnification

I agree to indemnify and hold harmless Dr Fitness International LLC from any claims, damages, or expenses arising from my participation or my violation of instructions or safety guidelines.

9. Minor Participants

If the Participant is under 18 years of age, a parent or legal guardian must review and accept this Agreement.

By allowing a minor to participate, the parent or guardian:

Assumes all risks on behalf of the minor

Agrees to the release of liability

Accepts full responsibility for the minor’s participation

10. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

11. Governing Law and Arbitration

This Agreement is governed by the laws of the State of California.

Any dispute arising from participation shall be resolved through binding arbitration in California under the rules of the American Arbitration Association (AAA), on an individual basis only.

The Participant waives the right to a jury trial and class action participation.

12. Acknowledgment

By participating in services, I acknowledge that:

I have read this Agreement in full

I understand its contents

I understand I am waiving certain legal rights
